القسم ا-ز الذي يعرف "المصنف" بالرغم من أنه يذكر أن الأمثلة مضروبة على
سبيل المثال لا الحصر، إلا أنه يغفل العبارات الدالة على المجالات العامة
للإبداع المذكورة في النص الأصلي مثل "the literary, scientific and
artistic domain [...]" أي "أي إنتاج في المجالات الأدبية و العلمية و
الفنية"، و كذلك "compilation of data to the extent it is protected as a
copyrightable work" أي "تجميعات البيانات على الأنحاء التي يمكن عدها
قابلة لحفظ حقوق المؤلف".

في نظري ان هذه التعميمات ينبغي تضمينها حتى لو تضمنت الصياغة أمثلة بعينها
و ذلك لترك مجال الرخصة مفتوحا على النحو الذي قصدت به دون تضييق مقيد.

من ناحية أخرى فإن المسودة تذكر "برامج الحاسوب سواء كانت بلغة المصدر أو
لغة الآلة"؛ و مفهومي هو أن الرخصة تسعى لسد فراغ الرخص الحرة في مجالات
الإبداع الأدبي و الفني و العلمي، لكنها لا تتصدى بنفس القدر لمجال ترخيص
البرمجيات و هو الذي يوجد فيه تراخيص أخرى أكثر تخصصا و ملائمة. الصياغة
الإنجليزية لا تذكر البرمجيات في أي موضع، لذا فنحن بحاجة للتمعن في هذه
النقطة و التشاور مع أشخاص من المؤسسة لبيان هذه النقطة بحيث لا تنأى
الصياغة العربية عن روح الرخصة.

Section 1-g defining "Work" omits some of the general definitions of of
works and their forms such as as "any production in the literary,
scientific and artistic domain, whatever may be the mode or form of its
expression including digital form [...]", and proceeds to enumerating
examples (while asserting this enumeration as non-exhaustive). It also
omits the generic definition of "compilation of data to the extent it is
protected as a copyrightable work".

However, it mentions "computer programs, either in source code or
machine code", something which in my opinion needs second thought as to
not stray from the spirit of license which - to me - seems to
intentionally leave this domain to other licenses while working on
satisfying the needs of artistic, literary and scientific domains.
