Barnes must answer questions about Bush

A federal judge declined to give former Lt. Gov. Ben Barnes protection from
testifying about whether he helped Gov. George W. Bush get into the National
Guard and avoid active military duty in Vietnam in 1968.

U.S. District Judge Sam Sparks on Thursday denied Barnes' request for a
protective order, but Barnes received some breathing room when his
deposition, scheduled for Thursday, was postponed until Sept. 22.

Barnes will be questioned under oath by lawyers for former state Lottery
Director Lawrence Littwin, who has filed a lawsuit against Gtech -- the
company contracted to run the Texas Lottery -- claiming Gtech was behind his
firing by the Lottery Commission in 1997.

Barnes, Gtech's former top Texas consultant, isn't a defendant in the
lawsuit.

But Littwin's lawyers are hoping to prove their theory that Barnes, while
House speaker in 1968, helped Bush get into the Guard and that decades
later -- when Barnes was at Gtech and Bush was in the governor's mansion --
Bush returned the favor by pressuring the Lottery Commission to fire Littwin
as he tried to open the state's lucrative lottery contract for bidding by
other companies.

Both Bush and Barnes have denied any role in Littwin's termination, which
came eight months after Barnes left Gtech.

"I didn't ask for any help; my dad didn't ask for any help," Bush reiterated
Thursday.

Barnes' attorneys called Littwin's subpoena of Barnes a "fishing expedition"
and argued in court papers that executive privilege protects Barnes from
questions about his role in recommending people for the National Guard.

Sparks chided Barnes' lawyers for waiting until less than 24 hours before
the scheduled deposition to stop the questioning.

Littwin's lawyers could not be reached for comment. Charles Burton of
Austin, one of Barnes' lawyers, declined to comment about why the deposition
was postponed.
