General: The Mitzvah of Shichechah
philip asked:
Regarding Mitzvas "Shikcha". Is the following mentioned anywhere?
If we know that this person has early symptoms of "Alzheimer", or any other
ailments that cause "forgetfulness," would his field be exempt from the
"Mitzvas Shikcha? or not.
-----------------------
The Kollel replies*:
It would seem to depend on how advanced are his symptoms. At some point in the
development of the illness, the person is going to go from being a Bar Da'as
(full awareness) to being not a Bar Da'as. When that happens he will be Patur
from all Mizvos including Shichechah similar to a Cheresh, Shoteh, v'Katan.
In fact, a person with very advanced Alzheimers might be even less than a
Cheresh, Shoteh, v'Katan. Rav Moshe Sternbuch in a Teshuvah (5:193) suggests
that even though there is a prohibition to feed a child on Yom Kippur (as
oppossed to allowing the child to eat on his own), there may be no such
prohibition by a person with severe Alzheimers. The reason for this is that
there is no prohibition to eat on Yom Kippur if there is no pleasure in the act
of eating (Hana'as Gerono) - for example, being fed through an intravenous tube
- and a person with severe Alzheimers might not even be aware of the pleasure
of eating.
Shanah Tovah,
Yonasan Sigler
