The kind of promptness the Media and police has shown in a rape by Saieny Ahuja
is rarely seen in cases of rape by security and police personnel. We all know
about the Sophian rape case in J&K, here I will tell you about the laser known
cases.
Both the cases are from Betul district in M.P. –
In a first incident a dalit lady gang raped by four police men in Amla Police
station - The story goes like this when Jankbai’s 25 years old son after having
caught his wife in compromising position with head constable N.P. Mishra of
Amla police Station threatened to raise the issue the head constable made
the same daughter-in-law of Jankibai complain against them that she faces
dowry harassment's at the hands of Janki Bai's and her family. On the basis of
the false complaint N.P. Mishra arrested Janki Bai, his son and Husband under
section 498A on 1st June 2009. After Multai JMFC turned down their bail
application the male were sent to Multai jail and janki Bai was taken back to
Amla Police Station and was kept their for night and was raped. When she was
brought at Betul Jail on 2nd June she reported the matter to the jail
authorities who informed Superintend of Police, Betul.
The main questions are - 1-Despite she being granted Judicial Custody why was
Jankibai was taken to Amla PS and kept their overnight. The police has no
authority over accused ones he or she has been granted judicial custody. She
should have been taken to women’s cell at Betul Jail which is just 50 Kms from
Multai and where incoming prisoner’s are accepted till late evening and they
are under legal obligation to receive them.. In case Had she been denied entry
by Betul Jail she could have been kept with women police at Betul.
2-When she reported the matter to the authorities through jailer on her arrival
to jail in the morning of 2nd June why was she not immediately medically
examined and her stained clothes were kept for MLC.
3- Why was she not taken to hospital for her MLc and it was done at Betul Jail.
Actually through out the day on 2nd June police tried to
persuade her to take back her complaint and after her refusal she was medically
examined only on 3rd June and that to at the Jail premises itself. The member
of visiting State Women's Right commission, Kamala Wdiwa who happens to be
Doctor by profession, also examined Janki Bai at jail and confirmed that she
had been subjected to physical assault and rape.
Though, the Betul Police has registered a case under section 376 of IPC against
N.P. Mishra and three other unknown police men so far no arrest has been made.
They have transferred head constable Mishra to Hoshangabad and Station In
charge to some other districts.
Meanwhile, authorities and state government, politicians are trying hard to
pressurise rape victim to change her statement.
In an another incident on 27th May 20009 a private company's security guards
employed by MP Electricity Board at their Sarni Plant. shot at group of boys
and women who tried to take on these guards when they molested a dalit women
Savitriti Bai. A tribal boy Guddu Korku injured in the incident succumb to his
injuries on 2/06/09 , Kevlram Suryavanshi is still serious in all total 5
people got injured in the incident. The police had just registered a case u/s
366,323,294, 34 and 304A and 287 of IPC. The security guards were bailed out
just after their arrest.

This is not the isolated incident we at Samajwadi Jan Parishad and Shramik
Adiwasi Sanghthana has been exposing corrupt practice of Betul Police and we
have taken up these issues. There are many criminal cases ranging from
kidnapping with intention to kill to dacoity has been filed against us by MP
Police and extenment notice also issued.
