Yes,you are right. Satisfactory Report which is lowest grade report is not 
treated as a case of adverse remark or reporting.

There is catch, if ACR is rated as "saitfactory" , it is as good as adverse, 
but as per rule need not be communicated.

     The correct position as per provisions of Service Rules applicable for all 
Government Offices as also all PSUs, is that any adverse entry made by a 
Reporting Authority in ACR of any employee / official should be communicated in 
writing to the concerned employee / official. In the given case matter in 
question, if there was an dverse entry recorded in ACR and if it had not been 
communicated to him, the Reporting Authority (RA) is liable for action against 
him. Further, ACR written  by RA is required to be reviewed by another senior 
level authority, who in turn is required to ensure and seek a confirmation from 
RA whether the adverse reporting has been communicated to the concerned 
employee.
 
      While the system takes care of the requirement in this regard, in actual 
practice it is however rather difficult to establish that an adverse entry has 
been recorded in ACR, as ACR is treated as confidential. Generally, RAs avoid 
recording adverse entries in ACR, and in cases where they want to cause damage 
to any employee / official which can have the effect of affecting the promotion 
chances, they generally do it by "downgrading the report" compared to previous 
report on record which is not seen & perceived as an adverse reporting. In such 
cases, which are common and frequent, the affected employee is generally 
advised to make a representation to the manaqgment / seniors with a request for 
being apprised whether there is any downgrading of reporting in his  ACR, and 
if so he be advised about the deficiency / shortcomings observed in his work 
which prompted downgrading so  that he makes an effort to improve his working. 
In such
situatiions, while he will not be given copy of his ACR and/or even extracts 
from ACR, he can know the broad picture about the manner of reporting in his 
ACR. SERVICE RULES APPLICABLE IN CASE OF ALL EMPLOYEES WHETHER IN GOVERNMENT OR 
SEMI GOVERNMENT OFFICES OR PSUs do not permit coppy of ACR to be made available 
to the concerned employee.

Dear Fellow RTIers

This CIC decision, and the subsequent one imply that "entries from the ACR" 
*MAY* be given to the concerned public servant (excluding armed forces) if the 
applicant can establish that some harm was caused to him by an adverse ACR 
which he has the right to represent against.

Copies of the ACR are still not permitted to be given, neither are the notings.
