Afaik, that is just a common myth-- similar to the myth that says that if a

well it is and it isnt. it does not exempt you from being sued for copyright infringement, but on the other hand, it does put you a little bit below the radar, the copyright owner has to go thru the trouble of finding out if the "promo" is indeed actually being sold. when we're talking small pressings in our little corner of the music industry, that little bit can help.

funny, this topic just came up on global darkness, where we were talking about selling promos/whites...

a prime example is i-f's "mixed up in the hague" cd on panama which was labelled as promo only. i dont think he was sued, but since then he has sought legal copyright clearance..so no mixed up #2 cus the licensing would be exorbitant, but we get those nice reissues like wanexa etc...
