The GPL does not forbid what he's doing, but he does need to indicate the free availability of the source code. IIRC that proviso is an aspect of the license and he must abide by its terms to stay within its protection. I may not fully support his plan, but I also can't call him a crook or a liar for taking advantage of the GPL. Remember, the GPL is a license mainly written to protect users, not developers. As such it is a very different kind of license than what commercial software usually carries, with very different implications.
