As some comments have already pointed out, this will only be valid for 
portions of Linux distributed under the new version of the license.  
For example, possibly not the kernel.

Also there remains the rather troubling legal issue of whether Microsoft 
should have known that they'd be giving away their patent protection 
rights when they signed the contract.  The judge really can interpret 
this anyway he wants.

Note: I'm not a lawyer.  I've been involved in lawsuits where unintended 
consequences were involved, and I've been shocked at the judges' 
interpretations.
