Authorities in the USA have really cracked down on file sharing 
copyright infringement in the last 2 years.  They've shut down most of 
the major P2P sites like the Gnutella network, and all the major ISP's 
(like Comcast and Verizon) have agreed to report every copyrighted file 
upload, and send a series of email warnings to the customer.  They won't 
say what happens after any specific number of warnings, but I suppose a 
subpoena could possibly follow.
So, of course you shouldn't download copyrighted material!  I'm not 100% 
certain a VPN or proxy service would still be able to hide your identity 
from your ISP.  If you do, you are taking a chance on getting a warning.
