We are happy to share with you yet another important advocacy
success of AICB which pertains to the issue of equivalence between
B.Ed. and Special B.Ed. degrees. As you may be aware that a large
number of persons both disabled and non-disabled, opt for the Special
B.Ed. courses in various parts of the country. While they are able to
get jobs as Special Educator Teachers after obtaining this degree, in
a large number of states, issues have arisen regarding their
eligibility to get jobs as teachers in regular schools treating their
degrees as equal to the General B.Ed. degrees. Instances of denial of
such opportunities had been reported to AICB causing hardships and
denial of opportunities of employment to hundreds of persons with
disabilities and others. Such a scenario also significantly diminished
the importance of the Special B.Ed. degrees. Realizing all these, and
using an instance when two visually impaired persons, holding Special
B.Ed. degrees, were denied the opportunity to appear for interview
for TGT teachers in Kendra Vidyalaya Sangathan (KVS) despite having
passed the written test, AICB directed its lawyer, Mr. Deepesh Aneja
to file a case in the Central Administrative Tribunal. The lawyer
based his arguments on certain guidelines of NCTE and also argued that
the Special B.Ed. courses are in no way inferior to the general B.Ed.
courses. The other side strongly opposed our contention and even
produced a letter from NCTE of 2014 implying that those holding
Special B.Ed. degrees were not eligible to apply for posts where
general B.Ed. or equivalent was the eligibility qualification. In
the meanwhile, the KVS took out another advertisement in which the
organization barred those holding Special B.Ed. degrees from even
making an application for the general TGT posts. So AICB filed another
case in CAT. We are happy to share with you that in a judgment which
is likely to have far-reaching consequences for the holders of the
Special B.Ed. degree holders, both disabled and non-disabled, the
Central Administrative Tribunal has accepted our contention and has
held that those holding Special B.Ed. degrees are eligible to apply
for posts of TGT teachers where general B.Ed. or equivalent are the
eligibility qualifications. The Tribunal has further stated that a six
month training recognized by NCTE may be given to such persons after
appointment. This judgment has opened the doors for hundreds of
Special B.Ed. degree holders to now be considered for posts of TGT in
regular schools. Also, it significantly enhances the status of the
Special B.Ed. degrees and it is hoped that more people will now be
attracted towards such degrees. While we congratulate our lawyer
Deepesh Aneja for forcefully arguing the case for hours, we also
request you to use this judgment in case anyone knowing you is facing
similar issues and/or any discrimination on account of holding Special
B.Ed. degree. Any other cases of discrimination and/or violation of
rights may also be brought to our attention. With best wishes,
