The Kerala High Court on Monday quashed the stipulation of the
Hindustan Petroleum Corporation Limited (HPCL) that a
visually-challenged person was ineligible to apply for regular LPG
dealership.

Justice A. Muhamed Mustaque issued the verdict, disposing of a writ
petition filed by P. Baby of Kanjirampara, Thiruvananthapuram,
challenging the HPCL rejecting his application for dealership.

The application was turned down on the ground that Baby was totally blind.

Violation of Art. 14

The court observed that the stipulation violated Article14 of the
Constitution (equality before law).

A visually-impaired person can carry out any function like an
able-bodied person without causing impediments, it pointed out,
adding: “Though a blind person cannot see, he / she could sense the
activities around with the insight vision.”
