Dear Friends, We are pleased to informyou that AICB has won as many as three important judicial activism casesinvolving a number of issues in addition to case of Mr. Jamalludin Vs. Govt. ofRajasthan about which we had circulated the information a few days ago. An important advocacysuccess of ours during the recent months has been the granting of one of ourPublic Interest Litigations by the Delhi High Court. This PIL was filed as theLife Insurance Corporation of India was discriminating against the blind inproviding reservation to the blind on the post of Assistant AdministrativeOfficer. The said discrimination became even more complex because LIC basedthis action of theirs on certain discussions held in the inter-departmentalCommittee of the Ministry of Social Justice & Empowerment, Government ofIndia and the subsequent directions of the Ministry of Finance asking theinsurance companies not to provide reservation to the blind on the post ofAssistant Administrative Officer. To bring this issue tothe fore, we had challenged an advertisement issued by the LIC for 700vacancies on the Post of Assistant Administrative Officer. In a recentjudgment, The High Court upheld our contention and directed that the post ofAssistant ?Administrative Officer be open to reservation in LIC (which byimplication also means in other insurance companies) in future recruitments. Itmay be mentioned here that as there are a large number of such posts in thePublic Sector Insurance companies, this judgment will probably benefit a largenumber of visually impaired persons. Our second importantsuccess has been against Allahabad University (a Central University). ThisUniversity had advertised 293 vacancies on various teaching posts but had notreserved any for persons with disabilities. We file a case in the Court of theCCPD. During the hearing, it came out that the University was not maintainingany rosters for PWDs. So the advertisement was quashed by the Hon’ble CCPD. Itis a matter of satisfaction that the University has accepted thisjudgment and has been in touch with our Vice President, Prof. Anil K. Aneja tounderstand the method of preparing the rosters. The University is is also inthe process of issuing a fresh advertisement now. The reservation to beprovided in it hopes to benefit a large number of persons with disabilities. As is well-known, thatAICB is at the front of taking up cases brought forward by individuals. Somemonths ago, a visually impaired person, Mr. Pratik Nikam approached us to carryforward his case against Employees Provident Fund Commission for not providingreservation to the blind and the low vision on the post of Assistant ProvidentFund Commissioner. We have won this case and the concerned employer has beendirected to provide such reservations. We are now in the process of carryingforward this matter further with a view to ensure that even the backlogreservation on this post in the concerned establishment is provided. Thus, you will see thatour advocacy cell is very active and is functioning very well under the ableguidance of our learned friend, Dr. Anil K. Aneja and others. With Kind Regards
