CIC fines BSNL Rs 5,000 for RTI mix-up

information


New Delhi: The Central Information Commission has slapped a fine of Rs
5,000 on Bharat Sanchar Nigam Limited for its failure to provide phone
call details to a customer who allegedly received an inflated bill.

"Due to inefficiency in recording and maintaining the required data,
the appellant's grievance could not be redressed. In view of this, the
Chairman, BSNL, on behalf of the respondent, is therefore, directed to
pay a compensation of Rs 5000," ordered the commission while hearing
the plea of Sunil Pandit Joshi.

Joshi, a resident of Nagpur in Maharashtra, was unhappy over the
inflated bills sent to him. He sought details of SMS and calls made
from his number from BSNL under the RTI Act.

The officials failed to provide him accurate information and asked him
to approach the grievance cell which could not offer any reprieve.

In his reply, the Chief Public Information Officer accepted that there
were erroneous entries in Joshi's bill. "Due to a technical snag in
the system of recording calls, the correct information about usage of
the phone facility could not be recorded, resulting in excess
liability," said the CPIO.

The CIC felt that Joshi had to pay more than the average bill as
compared to the previous months, thus, suffering financial losses and
hampering his attempts to seek justice.

"As a result, the appellant attempts to seek justice, has been
frustrated due to both technical snag in recording the call details as
well as lack of responsiveness of the officials responsible for
redressal of grievances under the auspices of the Grievances Forum,"
observed CIC while disposing off the petition.
