Dear All

Last week the
XRCVC has taken one more step towards providing equal opportunities for
visually impaired persons. Writer/Scribe availability and permissions by
diverse examination authorities has always been a point of concern.

XRCVC provides
regular support to various visually impaired persons for ensuring that their
due rights are respected by examination boards and authorities as per existing
rules and guidelines. One such case came to the XRCVC last week. Mr Sameer
Latey was appearing for his NABARD Assistant Manager examinations. NABARD was
not agreeing to relax the unreasonable rule of the writer not having secured
more than 50% in his/her last latest examination.

XRCVC tried
negotiating with NABARD. These did not bear fruit. As a final recourse in order
to get due justice the XRCVC supported Mr Latey to move the High Court. The
Honourable High Court in the emergency hearing held on 26th March
2009, passed an interim order acknowledging the due rights and request of Mr
Latey. The hearing is to be followed up in the court after 6 weeks, where the
XRCVC will aim at re-working the inequitable NABARD rules for the long term.

Many thanks to
Ms Kanchan Pamnani, Advocate and Solicitor who worked as the XRCVC’s legal
consultant for the case and to Ms Ankita Singhania who appeared in court on
behalf of Mr Latey.

We would request
all of you to either write into us or Kanchan off the list mentioning the
prevailing writer rules for your local school boards, college/universities
and/or recruitment/examining authorities. This data will help us build up a
broader case.

Regards,Dr. Sam Taraporevala
Director
