LUCKNOW: The Lucknow bench of the Allahabad high court, on Friday, stayed all 
the appointments in the state government for the next three months, until the 
backlog vacancies of the blind and disabled persons have been filled up. 

"The state government or its authorities shall not fill up any vacancy within 
the domain of the state government or instrumentalities unless from the initial 
stage that is from the stage of advertisement of posts for recruitment to fill 
up the posts, reservation of 3 per cent under Persons with Disabilities (equal 
opportunities, protection of rights and full participation) Act, 1995 is 
earmarked and simultaneously filled up from open recruitment process,'' said 
the division bench of Justice Devi Prasad Singh and Justice V K Dixit. 

The court directed the state government to identify the backlog vacancies for 
such categories within two months and thereafter, fill them up in the next one 
month. It directed principal secretary, personnel department, Kunwar Fateh 
Bahadur and principal secretary, Viklang Kalyan, R P Singh, who were present in 
the court, to file personal affidavit indicating action taken by the state 
government. It directed the government to issue a circular in this regard 
within one week. 

The judges cautioned the state government that non-compliance of the order 
shall amount to contempt of the court and it may proceed suo moto against those 
who will be at fault in not filling vacancies for blind and disabled persons 
under the Act. It directed chief standing counsel Devendra Upadhyaya to 
communicate the order to the chief secretary for forthwith compliance. 

The order came on a writ petition filed by National Federation of the Blind. 
Its lawyer, S K Rongta, argued before the court that it was mandatory for the 
state government to fill the quota meant for blind and disabled. According to 
him, there is 3 per cent quota in the appointments in the state government for 
disabled. One per cent quota is available to blind persons. About 2,000 
vacancies are to be filled up for blind quota. 

The court directed the state to ensure that not only the quota of blind but 
also the quota of other categories under the Act is filled up within three 
months. The court has fixed March 3, 2011 as the next date of hearing, when the 
state government will have to submit action taken report.
