RETAIL LOANS TO VISUALLY CHALLENGED PERSONS

 

1. RBI, vide Notification dated 4.6.2008, has, inter alia, advised to ensure 
that retail loans are invariably offered to the visually challenged persons 
without  any discrimination.  

 

2.       It may be noted that a blind person of sound mind is competent to  
contract, as such there is no legal bar for granting of loans to blind persons. 
 All concerned are, therefore, advised to ensure that retail loans are not 
denied  to the visually impaired persons.

 

3.       As regards the procedure and precautions required to be taken for  
execution of documents, it is advised that all documents to be executed by the  
blind persons be witnessed by two witnesses.  A declaration be obtained from 
the  witnesses to the effect that the documents have been read over and 
understood by  the blind person in their presence who after understanding the 
consequences thereof has put his signature in their presence.  

 

4.       The other precautions as provided by the Bank for opening of the  
accounts by the blind persons be also taken care of.  In some of the States,  
documents evidencing creation of mortgage needs to be stamped. In such States,  
the mortgage deed can be got registered.   Further, where the blind person is  
conversant with Braille language, the documents in the said language may be  
provided  to him/her (optional).  

 

5.       All concerned are advised to note the above guidelines for compliance.
