hello all,

Pasting below a significant Delhi High Court order that mandates
stringent action against Delhi University colleges that are yet to
comply with the roster-based reservation for the appointment of
persons with disabilities. The order is equally crucial in its
clear-cut articulation of the need to put the roster in the public
domain, something on which we often find academic  institutions
unjustifiably reluctant.

One can hope that this will go a long way in ensuring much-needed
transparency in the implementation of reservation in appointments and
would benifit not only the disabled, but other vulnerable social
groups as well.

In response to the status report filed by respondent no. 1 University,
the petitioner has filed a rejoinder stating that the information
disclosed by the constituent colleges which is the basis of the report
is not fully correct. Learned counsel for respondent no. 1- university
states that they have put these aspects to the colleges and have
elicit their response. It is, however, not in dispute that some of the
colleges are repeated defaulters in complying with the directions of
the Court. Learned counsel for the University states that there are
five such colleges, viz., institute of Home Economics, Jesus & Mary
College, Lady Irwin College, Sri Guru Gobind Singh College of Commerce
and Sri Venkeshwara College.

The University may serve a last notice on these colleges to show
compliance failing which the University should forward the names of
these colleges to the UGC for appropriate action to stop their grant.

Learned counsel for respondent No. 1-University states that she will
also examine as to how the Monitoring Committee can be made more
effective and whether, at least, one of its members can for the time
being give exclusive time to this committee so that the implementation
is completed.

Let notice issue to respondent No. -1 University, which is accepted by
learned counsel.

Reply, if any, be filed within four weeks. Rejoinder be filed within
two weeks thereafter.

In order to ensure transparency it is directed that in the main time
respondent No. -1 University and other affiliated colleges as also all
respondents herein will keep their roster in public domain displayed
on their website. This order should be complied with within four
weeks.
