You could not have been more beyond the mark.
As an analogy, would you say because 1% seats are reserved for orthopedically
disabled, they cannot and should not be appointed on remaining 99% even though
they qualify for them in unreserved category?

Please give rational thought to the matter.

If some posts are identified, it means and law is very much clear on this after
supreme court's interpretation, that those identified posts are to be used for
filling up vacancies reserved.
Even quantum of reservation is independent of identification.
Section 32 cannot be used to thwart section 33 of PWD act.

In logic, the statement:
"Some people are honest"
does not mean
"Some people are dishonest."
But it only means
there is at least one entity who is both a person and honest...

The list of identified jobs is merely an indicative list, mentioning the jobs
which can be performed efficiently and which should be used for filling up the
reservation.
Reasonable accommodation forms the core of disability rights and with
reasonable accommodation almost all the jobs can be performed by persons with
various kinds of disabilities.

List of identified jobs is to be updated every three years.
So, does it mean every three years jobs which are added become performable
overnight?

Law is an evolving process.
Life of law is not only logic but also experience...
So, Mr. Abidi, do not take such absurd and rigid stands...

Hi, George.

Am not clear as to what do you mean by that. Please elaborate.

I mean when you identify say 150 posts out of 400 for B which denotes Totally
Blind, then obviously automatically it means that the remaining 250 posts are
not identified for them and therefore they would never ever be even considered
for those 250 posts even if fully qualified.

Let there be no confusion on this.

Technically that should not be the case but in reality that is true!

That's interesting! So, let's have an exhaustive debate on this very point:

Is identification of jobs good or bad?!

And, Rajesh you can't have it both ways. When some jobs are identified,
obviously the rest of the jobs would be denied.

No, I don't quite agree.
Identification of jobs, is not, per se, bad.
It is bad when the list is used as exhaustive list and people are denied
jobs not identified...
Such practices are resorted to without legal sanctions...

And, please refrain from using visual metaphors like eye opener, as they
falsely equate ability to see with ability to know....

I agree with Avinash. However, this "arbitrary business" of job
identification is not done by the Government alone. They can't dare to. It
is done with the active support and collusion of our own people in the
disability sector! Therefore, please find out as to who served on the
Expert Committee and the 3 Sub Committees on behalf of disabled people. It
may serve as a big eye opener for many of you.
