The Office of Chief Commissioner for Persons with Disabilities (CCPD)
has directed the Bihar State Commissioner for Persons with
Disabilities to take suitable action to ensure the statutory three
percent reservation for differently-abled candidates in the recently
advertised posts of Assistant Professorship in universities of Bihar.

This intervention by the CCPD has come in response to a
petition/complaint filed by G.N. Karna, JNU's expert on Disability
Studies and honorary president of the Society for Disability and
Rehabilitation Studies.

"In our petition filed on September 25, 2014, the Society for
Disability and Rehabilitation Studies had alleged blatant violation of
three percent reservation guaranteed to the differently-abled inter
alia Articles 32 and 33 of the Persons with Disabilities (Equal
Opportunities, Protection of Rights and Full Participation) Act, 1995,
(normally referred to as "PWD Act 1995")," noted Dr. Karna.

He explained that while advertising for a total of 3,364 posts of
assistant professorship in various subjects in the universities of
Bihar, the BPSC has deliberately left out the differently-abled.

"Though reservation has been spelt out clearly in case of other
special categories, the prejudiced attitude on the part of the BPSC is
further reflected in denial of or discrimination against the
differently-abled in respect of relaxation in payment of prescribed
fees," said Dr. Karna.

Prima facie the BPSC action has given the impression that reservation
of three per cent granted to the the differently-abled, is not
complied with and flouted arbitrarily by the Government of Bihar, he
claimed.
