I wonder why all this is happening in the home state of Prime
Minister... How many times Judiciary will have to step in?

AHMEDABAD: Gujarat High Court has directed the state government to
accept the applications of disabled people applying for the posts of
vidyasahayak. The state government had recently decided to appoint
more than 4,300 vidyasahayaks across the state.

 Activists fighting for the rights of disabled people had protested
when they came to know that those with more than 75% of disability
were not allowed to fill in the forms online. According to norms, 3%
of the vacancies are to be filled by physically disabled and blind
people.

 Justice R H Shukla, acting on a petition filed by Gautam Maru
challenging the state government and president of the Gujarat State
Primary Education Selection Committee, on Friday directed the state
that the applications of the petitioners will have to be accepted
either online or in any other form.

 The petition said the advertisements in newspapers were silent about
the criteria of the disability for the candidates. When the applicants
visited the website and mentioned that they were more than 75%
disabled, their applications were not accepted by the software.

 Moreover, the number of posts mentioned in various categories was
less than the stipulated 3%.

 "It is the responsibility of the government to provide an equal
opportunity to the disabled people under the PWD Act. It has been
observed in a number of judgments by Gujarat high court and Supreme
Court where the judiciary has upheld the right of the disabled people
for the positions. We have also observed in Gujarat that the court
ordered the appointment of Rajesh Mulwani, a 100% blind person, as
DIET principal," said Jagruti Dekavadiya, advocate representing the
petitioner.
