The Delhi High Court has summoned the principal secretary of education
to appear before it on Monday, in a contempt case filed by the parent
of a differently-abled child regarding facilities in schools for
differently-abled children.

During Friday's hearing, the court of Justice S Ravindra Bhat and
Justice Vipin Sanghi pulled up the Directorate of Education (DoE) for
failing to verify the facilities available at the city's private
unaided schools for differently-abled children.

The court had issued orders in September and again in November to the
DoE to complete the verification procedure and submit a report.

However, the DoE, in an affidavit, told the court that the inspection
process had not been started. The court said it would exercise
contempt jurisdiction since the government did not seem to be
following its orders.

The court had issued similar orders for appearance of the principal
secretary earlier. But, it had exempted him from appearance after the
DoE assured that all steps were being taken to ensure that
differently-abled children get admission in nursery and that
facilities for them are provided in schools.

DoE's latest affidavit, however, stated that "the process of verifying
facilities in private schools will begin after March 2015, once the
checklist is sent from the office of Rehabilitation Council of India
(RCI)... Delhi Assembly polls can also be declared at any time and staff
of the respondent department is to be deputed for that purpose too".

DoE also stated that it shall "immediately cooperate" with the RCI and
the disabilities commissioner to secure the services of trained
experts, who can evaluate the facilities.
