To, All Registered Organisations of National Trust, Parivaar Members, NGOs working in the PwIDD sector, Media and MSJE officials Dear Friends, At the outset a very Happy, Healthy and Purposeful New Year to all of you. Alongwith it grateful thanks to all for the overwhelming positive response to the circular dated Dec. 24, 2014 regarding the National Trust affairs. With this response we must proceed further with an action plan to save the National Trust which is one of brightest beacon of hope for the future of our children. As predicted the Government of India did not give an extension, even a short one for six months and relieved Mr. P K Pincha of his post of CCPD and of the additional charge of Chairperson of the National Trust on 26th Dec. 2014 itself. Infact, the Government displayed such indecent hurry to pack off Mr. Pincha that they did not even go according to the stipulation of their own office order which had put 31st Dec. 2014 as the date upto which he was given the additional charge of NT Chairpersonship. They hurriedly modified the order to coincide with his term of office as CCPD which was 27 Dec. 2014. Now the worst has come true. For the first time since the NT became functional, a Government official has been given the charge of heading the NT., violating the provision of the NT Act. But it was quite amusing to watch how the Government functions. Reportedly, the Government orders issued by the Ministry gave the charge of the CCPD and additional charge of NT Chairperson to the Secretary of the Dept. of Disability Affairs, MSJE Mrs. Stuti Kacker who was scheduled to retire on 31st Dec. 2014. So she had only three working days left of her service at the Secretary of the DDA. This reminds one of the *'Ek Din ka Sultan'* story. Anyway, we are neither surprised nor amused of these antics of the Government. We have a serious issue to tackle before us. We in the Disability sector in general and PwIDDs sector in particular do not want a Government official (a bureaucrat) to head an organisation which deals with the special needs of PwIDDs. So far the post of NT Chairperson was held by persons who had long years of experience of working and knowledge of one or more of the four disabilities under the N.T. Act. A bureaucrat, who might be a good administrator but has no such experience and knowledge will not be acceptable to the sector. We have already made our stand clear as to what the sector wants and there cannot be a compromise on it. We do not accept the present arrangement and we want a suitable person from the disability/NGO sector even if he/she has to hold the temporary charge of the post of N.T. Chairperson till a regular one is selected through the legal process and the process must start immediately and completed swiftly. In the present situation, Mr. P K Pincha, the just retired CCPD who was holding the additional charge of NT Chairperson from 24th Oct. to 27th Dec. 2014, had proved in such a short time that he was capable of delivering and put back things in proper order in the NT. He was forthright and though he was working only part time in NT office had taken and implemented a few important decisions. Though he had not worked in the PwIDD sector, he had shown complete understanding of the issues and the special needs of PwIDDs and the primary objectives of the National Trust. If he was allowed to function in this capacity for another six months to one year, we are sure that he would have brought back the functioning of the NT to normal which was completely derailed by a self-serving Government appointed JS/CEO of the NT. We should, therefore, strongly demand that Mr. Pincha should be brought back to hold the temporary charge till a regular Chairperson is appointed through a proper legal process. Incidentally, the Government could have given an extension to Mr. Pincha but for his upright stand in refusing to bow to the pressure which was being brought on him to do certain things which were strictly not legal and against the rules. He had also written to the Minister MSJE about it. Secondly, Mr. Pincha had requested in writing to the Ministry to give him an extension in the CCPD post as far back as July 2014. But it is understood that his request was turned down by the Jt. Secy. through a noting on the file in the month of Sept. 2014 but not informed officially to Mr. Pincha till a couple of days *after *he was relieved as CCPD. However, the higher sources in the Ministry are now spreading a rumour that Mr. Pincha was refused extension because he had filed a writ petition against the Ministry for writing an "offending" letter to the Minister MSJE. After all, asking for an extension and filing a writ petition for redressal of grievance is no offence. Secondly, Mr. Pincha has stoutly denied the charge that he had written any "offending" letter to the Minister because of which his request for extension was turned down. Apart from demanding Mr. Pincha's recall, the sector will have to take a serious note of the reported efforts being made by the former JS/CEO of NT, who was repatriated by the Government on 5th Dec. 2014, to come back to the post. Actually, you all know how he brought about the functioning of the NT to a standstill; indulged in many acts of irregularities and illegalities; challenged and defied the authority of the NT Board and Chairperson and played havoc to damage the whole system. There are also serious charges of alleged corruption against him. The sector will have to stoutly resist if any such attempt is made by this ex JS/CEO and oppose it tooth and nail if there is complicity on the part of the Government in helping him to come back. You should also know that the entire disability sector is with us in this struggle of ours to save the National Trust. It is certain that if we raise a united strong voice we will definitely triumph.
