Hi Renuka, The answer to your question is "it depends" and I am not a lawyer. Has the disk been written to after the format? If so, then the chances for you to retrieve the data are slim.
Yes, there is software to recover data. One of the best ones is spinRite. https://www.grc.com/sr/spinrite.htm If the data is critical, you will want to use a Linux distribution such as grml to image the drive and then run data recovery operations on the image. Otherwise, a data recovery professional is your best bet. They do not come cheap.
