A-ha! Yes. Having just cold-booted on battery (and still on battery),

[ja...@rhapsody ~]$ cat /sys/devices/system/cpu/cpu0/cpufreq/bios_limit
2101000
[ja...@rhapsody ~]$ cat /sys/devices/system/cpu/cpu0/cpufreq/scaling_max_freq 
2101000
[ja...@rhapsody ~]$ cat /proc/acpi/ac_adapter/*/state
state:                   off-line
[ja...@rhapsody ~]$ cat /sys/devices/system/cpu/cpu0/cpufreq/bios_limit
1200000
[ja...@rhapsody ~]$ cat /sys/devices/system/cpu/cpu0/cpufreq/scaling_max_freq 
1200000

So the BIOS limit isn't set until the AC state is polled.
