Kim:

We don’t have a policy that addresses this issue, but there are a couple notes
below, provided by our Research staff, that might be helpful, depending on what
you are looking for.

Can you send me the link ([email protected]<mailto:[email protected]>) to your
policy – our Graduate School is interested in it.

Thanks! -Eunice

Hi, Eunice.
Jen asked me to address your request below.

Questions about whether faculty can employ students in his/her university
startup, and/or advise students on projects sponsored by external entities in
which faculty have a significant financial interest (including equity) come up
from time to time. Those issues are reviewed by the graduate school (Scott
Herness), which determines whether the advisor/advisee relationship can
continue, given the potential issue of the faculty member personally benefiting
from the work done by students at the university. The concern is that students
could potentially not be appropriately advised by a faculty member who can
personally gain from the results of the research; further, there are potential
Ohio ethics issues that are implicated by such an arrangement.

Additionally, there are Ohio ethics concerns about faculty members being a
party to a public contract, if s/he works for an external entity that is
involved in sponsoring research activities at the university, and the external
entity is not a UTCC startup company.

Relevant policy reference is: Board of Trustees, Chapter 3335-13-07, University
Property, sections F and
G<http://trustees.osu.edu/rules/university-rules/chapter-3335-13-university-property.html>.
The Graduate School Handbook may also discuss this issue.

Please let me know if you need any additional information.

Thanks,
Suzy

The Graduate School handbook does have information on outside employment but it
is a bit different than what Kim was referring to and does not specifically
address faculty employing students in companies where the faculty member holds
an ownership interest.

· Outside Employment. A GA should determine whether the Graduate
Studies Committee of his/her program has an established policy governing this
issue. Graduate Studies Committees are encouraged to establish a policy on
outside employment for graduate associates. A GA who is considering additional
employment outside the university should consult his/her graduate advisor. A
careful evaluation of the impact of additional commitments on the student’s
academic progress and on the student's GA responsibilities should be made.

Would it be possible for us to ask the University of Connecticut to share the
current policy that they have given that we have recently had a similar
situation arise?

Thanks!

Lori

Lori and Jen:

I got this request from ACUPA (Association of College and University Policy
Administrators) – do you know of such a rule or policy? Neither Briggs nor
Tracey do, and Briggs thought you two might, if we had something. See
highlighted request below.

You might check with the Graduate School and the Office of Research. If we do,
it’ll relate to one of those.—Briggs

Subject: [acupa-l] Students employed by companies owned by Faculty

Good Morning,

We currently have a policy on the use of students in outside employment, which
addresses the process for faculty to employ students in companies where the
faculty member holds an ownership interest. I wanted to compare our policy
with those at other institutions. Does anyone have similar policies they would
be willing to share?

Thank you,
Kim
