What a wonderful opportunity to be a part of the search process!  One of the 
questions I would definitely ask is "What do you see as your role in the 
development of University policy?"

While workload will likely impact the amount of time your new General Counsel 
will be able to devote to policy, I think it's crucial that they see themselves 
as an important part of the process, to assist rather than to hinder the 
process.
