Romita, wife and mother, faints at SUHAKAM

-         Family starts signature petition for Family Re-Unification-

 

Free Abdul Mutalib, Re-Unite the Family

& Let Them ALL Remain in Malaysia

 

At about 3.30pm, 29/4/2005, at the SUHAKAM (Human Rights Commission) office, Romita Hasibuan, the mother of  Maruly Aziz Bin Abd Mutalib(12+ tahun), Sarah Nor Varah Hanim Binti Abd Mutalib (11+tahun), Yonatan Adam Fauzi Bin Abd Mutalib (9+tahun) dan Ismael Syah Putra (6 + tahun) and the wife of  Abd Mutalib Bin Taib fainted and collapsed.

 

She and the family have been desperately going to SUHAKAM every day since the handing over of the Memorandum of Appeal on 27/4/2005. Abdul Mutalib, her husband was arrested on 23-3-2005 and has been detained at the KLIA Immigration Depot.

 

Romita has been struggling for their family to be re-united and for them all to be able to continue to live in Malaysia as a family unit as they have done since marriage and the birth of all their children. There is now a possibility that their father, Abd Mutalib may be deported back to Indonesia after his Permanent Resident status has been revoked, and this would mean that Romita too, who is here in Malaysia by virtue of a spouse visa, due to expire in September 2005,  may also have to leave Malaysia. All their children are Malaysian citizens and this is also evidenced by their Birth Certificates and/or the Malaysian passports issued to all 4 of them in 2003.

 

Earlier, Romita Hasibuan had heard that her husband had been removed from the KLIA Immigration Depot, and she was worried that he may have be deported. This could been a factor that brought about her collapse at SUHAKAM.

 

At about 4.00pm (29/4/2005), Mr Roland Engan of Messrs Charles Hector  & Co did call the Immigration Department, and spoke to the Secretary of Datok Ishak, the Ketua Pengarah Penguatkuasaan Immigresen (Chief Director of Immigration Enforcement), who was not able to say whether there has been any pre-mature deportation or not.

 

It must be stated that SINCE THE LAST DAY OF APPEAL WOULD BE 29/4/2005, NO DEPORTATION CAN BE DONE UNTIL AFTER THAT PERIOD SO WE BELIEVE THAT THERE WAS AND CAN BE NO DEPORTATION ON 29/4/2005.

 

Further more, since the appeal to the relevant Minister was sent on 27/4/2005. On 28/4/2005, we, as the lawyer for Abd Mutalib and his family, also did send a letter of appeal to the Director General of Immigration, to be forwarded to the Minister, In our letter, we also asked for the grounds/reasons of the Orders to be provided, for without that an effective and/or proper appeal is near impossible. We must state that to date we have not received any response from the Home Minister and/or the DG of Immigration.

 

Given the fact that there is TWO(2) appeals already submitted, we believe that the appeals will first have to be heard and considered before any order to Deport or otherwise will be made. The decision of the appeals will have to be communicated before Abd Mutalib can be deported.

 

We have also heard that the Home Minister is presently out of the country, and will return soon. We and our clients hope that the Minister of Home Affairs will be compassionate to the plight of this family, who is now struggling to keep their family together and to continue their lives in Malaysia as they have always done.

 

The family would also like to announce that they have initiated a public signature campaign in an effort to keep their family together in Malaysia. The petition, in its last paragraph reads � We, the undersigned hereby appeal that this family be re-united, and be allowed to remain in Malaysia as a family unit, as they have done since marriage and the birth of all their children. We also urge the Malaysian authorities not to separate children from father, wife from husband, children from mother and/or siblings from siblings and to do all necessary to re-unite this family�.

 

The family also hopes that SUHAKAM, the Bar Council and all other concerned persons would help them in this plight to keep their family together and for justice.

 

Free Abdul Mutalib. Restore and recognize his PR status, and his children�s citizenship and allow this simple loving family to continue to leave peacefully in Malaysia as they have done all these years from the date of marriage and the birth of all 4 children.
