If you shoot someone's bedroom window from a public sidewalk, for example, with a "normal" lens, thats OK, but you would have an expectation of privacy against a 400mm lens. What you can see with the naked eye is pretty much unprotected in public places. (with some caveats, you can't use it for advertising, you can't type a misleading cutline, you can't publicly reveal a private fact, etc. )
Same at the mall I would guess. A cell phone photo is one thing, looking up your skirt with it is quite another. These are the guidelines we always followed at the newspapers I've worked for. And, at shopping malls, we always got permission in advance and checked in with security upon our arrival.
