Unless there is something beyond my ken going on, I would have to
conclude that either the operation being performed is not Backup, or
that the process performing what we perceive to be a Backup is not
using the expected options file to pick up those Excludes.  I would
recommend verifying whether the issue persists in a manual backup
that was preceded by a verifying 'dsmc q inclexcl'.  You could pursue
a client trace to further narrow down the problem.  Consider also
boosting the maintenance level of that client, which is currently
very early 5.3.

If this problem started happening at a point in time, and was not
happening before, look into what system changes and/or service
restarts coincidentally occurred.
