I don't think there is legal requirement to be a CLEC to colo in any place.
However, back in the day they could not refuse you if you were a CLEC.
But the FCC killed DSL for non facilities based providers probably 18
years ago. I don't remember the order but it was something like the
cablevision order.
I don't know if the rights of a CLEC forcing their way into the colo
room got eliminated as part of that order or not.

Are you able to colo in their remote COs? How hard is/was it to connect
to their copper in the COs to provider DSL service?
How responsive were they to fixing copper issues on the copper plant
