Looks like from that document it's still not so clear cut though. I haven't really kept up on this, but according to the article, 10 states still prohibit it, as does AMEX.

Either way, it's something I would put some time into researching before implementing, as it the couple of bucks you'd make on the surcharge would quickly by eaten by having to defend it in any way..

    pull your merchant agreement. For good reason. I hate companies
