I would attempt the reasonable guy approach first.  Contact former 
owner/customer and get their story.  Tell them they are liable.  Get them to 
reason with the new owner if possible.

Perhaps not, but I cannot afford to replace 3 radios this just happened to. My 
company is t very big and every single penny counts. Maybe I'll enforce my ToS 
and charge the former customer the radio cost.
