Assuming you're operating in FCC-regulated areas, then yes, 5.4 is regulated by 
different rules than 5.7 GHz.

The maximum EIRP in 5.4 GHz is 30 dBm, where it's 36 dBm in 5.7 GHz.  Also, 
equipment operating in 5.4 GHz must have DFS enabled to detect radar signatures 
and energy.
