Proto-proposal: Arbitration Service
Amend Rule 2147 (Protectorates) to be titled "A Friend in Need" and
to read:
Whereas Agora, being the Friend of All Nomics, has an inherent
responsibility to lead the nomic world; and whereas Agora
desires to encourage growth and promotion of the nomic
community, be it hereby known that Agora shall serve as
arbitration service to any nomic which requests such a service.
A neutral or friendly Nomic (hereafter the friend) may make a
formal request for Agora to issue a Friends of Nomic Decree (FOND)
to that nomic. The request SHOULD specify the requested contents
of the decree, the effects the decree would have on the friendly
nomic, and the reasons for the request. The request MUST be made
by announcement in Agora or through a similar mechanism in the
friend's public fora.
Amend Rule 2159 (Protective decrees) by changing its name to "Arbitration Cases"
and amending it to read:
As soon as possible after formal request for a Friend of Nomic Decree
(FOND) is made, the ambassador SHALL announce the request in both
Agora and in a public forum of the Nomic affected by the decree. In
this announcement, e shall assign the Decree Request to a judicial panel
(the arbitration panel) consisting of three senators who SHOULD not be
members of the friendly nomic in question.
In the same message, the ambassador SHALL announce eir own opinion on
whether the FOND, if published by the ambassador in the friend's public
fora, would have a reasonable legal effect within that Nomic. The
ambassador SHOULD take into account factors such as whether the
person making the request was authorized to request the FOND or whether
the friend's Rules would take notice of the FOND, and to what extent,
and to whether the FOND would be a benevolent response to an emergency.
The Arbitration Panel SHALL, as soon as possible, announce a FOND
to be issued based on the request, thus closing the case. The FOND
may be phrased so as to have an effect requested, no effect, or
another effect on the friendly nomic. Decrees that have effects SHOULD
only be issued for the purpose of assisting the friend in its growth
and enabling its longevity. FONDS should always be benevolent.
After the Arbitration Panel judges, the Ambassador shall wait at
least four days before taking action. During that time (1) if no
Proposal is initiated nullifying the decree, the Ambassador shall
issue the FOND in the friend's forum and in Agora. (2) If a proposal
is submitted to specifically nullify the FOND, the Ambassador shall
wait until the Proposal's decision has been made, and if the decision
is nullified, announce the effects in Agora and in the friend's forum.
