No, this cannot be fixed IMHO.
A User field always has the same value across the whole document. If you change
the value somewhere lower in the document, it will also change its value in the
parts above the current field position.
If User fields of an identical value is used by someone cannot be determined by
the loading process of a file.
Also if you have a User field in a protected section (not linked) it is possible
to change its value in an unprotected part lower in the document - this is
intended.
