I think it only happens occasionally in some projects when one does an incremental re-build in the same build tree where one has built earlier. Is such incremental rebuilds officially not recommended? Anyway, just a few lines above the line that Fridrich's patch touches are corresponding rules for unpacking tar archives. Nothing is done there to prevent tar from overwriting existing files. (Like using the -k option which at least GNU tar has.)
