this is caused by a difference between libxml2 version 2.6.17 (which is used by
ooo) and older versions (such as 2.6.16, which is shipped on mac os x).
the older version considers it an error if xmlXPathEval is called with a context
node that has a document which is completely empty, i.e. with no root element.
in version 2.6.17 this was changed and is no longer considered an error.
