Under some weird circumstances an annotation inside a list item can cause the 
list-item to be displayed like a normal paragraph. (I didn't try printing the 
document, so I don't know whether it's only displayed wrong.) For the example 
file I took my document and manually edited the content.xml file until I got 
the simplest circumstances under which the error occured. It must have 
something to do with the annotation containing two paragraphs as when I removed 
one, the error didn't occur any more.
And yes, the tags were nested as they are now before I edited the XML file 
manually. I don't really know much about the format, so I can't tell whether 
the way the tags are nested is unusual.
