First investigation reveals that the changed font size which is set at the empty
paragraph is not set as a paragraph attribute - it is set as a character
attribute. Thus, the list label does not respect the font size change, because
the list label only respect the paragraph's font size.
Another workaround:
Switch order of steps (2) and (3)
Due to limited resources, I have re-target this issue to OOo 3.x
