I checked with "Ooo 3.1.0 RC1 multilingual version English UI WIN XP: [OOO310m9
(Build 9396)]" and found out:

When you open a document containing 2 or more times the same linked OLE object a
message "document in use" will appear.

Steps to it produced the problem:
0. unzip attached test kit
1. open "test2.odt" or "test2.ods" (containing "TheElectronicMail.odg" 2 times
   as linked OLE object)
expected: document should open without any problem
actual: Message appears, you have to decide how you want to open the
second copy of "TheElectronicMail.odg". If you select "Canel" in the
message box, only a place holder will be shown instead of the object.

The problem does not appear for documents with only one linked OLE aobject in it
(test with "test1.odt"!).
No problem with "Ooo 3.0.1 (DE) Multilingual version English UI WIN XP:
[OOO300m15 (Build 9379)]"
