This effect is part of the general problem of element stuck together or at the
top of the document (see for instance issue 7747).

The workaround is to avoid inserting a TOC directly after a page break but on
the other hand, separating them from each other IS possible.
- You have:
<page break>
<index TOC>
- make sure the index is not write protected (Index properties)
- set the cursor a the first position of the index (i.e. "|Table of Contents")
- Press Alt+Enter (creates a new paragraph inside of the index)
- Context menu - Update index (the page break is deleted and the index jumps to
the previous page)
- set the cursor at the paragraph before the index and press Ctrl+Enter
-> you get:
<page break>
<empty paragraph>
<index TOC>
