This is NOT fixed, since 000310m17 (build9415)has still problems with "comma
below" characters, while the characters with cedilla work fine. 

I do not know the syntax of ro_RO.xml, but one solution might be:

<IndexKey unoid="alphanumeric" default="true" phonetic="false">
A Ă Â B-I Î J-S Ș Ş T Ț Ţ U-Z</IndexKey>

Or is there a way to say that Ș Ş have the same value? Ș=Ş ? 
Anyway, if this is not possible, and one character has to be selected, the comma
below characters are the official ones, so they should be used: 
A Ă Â B-I Î J-S Ș T Ț U-Z
