I've noticed this behaviour too. Maybe the driver still needs some refines. However it does note seems to happen with the Ogle player, the DVD menu support is quite new for xine.
[¹] xine did have some odd behaviour when it came to navigating dvd menus that didn't have sound on all pages. It would make some highpitched noise when entering a silent page. Don't know if the problem is with xine or the driver, but it sounds like the spdif loops the last few samples instead of going silent.
