There's no particular regulatory problem, but all current Altus Metrum products are in transmit-only mode (not listening on the radio) during flight. This cleanly solves a bunch of corner-case safety issues, but makes it impossible to do what you're talking about. Frankly, though, I don't think it's a very useful feature. In all the cases I can recall where I or someone I knew suffered a ballistic return, we heard the high-pitched whistle and/or ground impact before we fully understood what was happening! So, I'm personally far more interested in figuring out how to have the on-board computer figure out what's happening and doing whatever the smartest thing is under the circumstances rather than trying to re-think the transmit-only-in-flight decision...
