Are you talking about Droid, Milestone or HTC Tattoo here? Thus far there seem to be 2 separate patterns: apps can be invisible on the Market for Droid and Milestone when copy protection is on, OR apps can be invisible on the Market for HTC Tattoo when the CAMERA permission is used.
