Interesting discussion. 3.3 - "All fees received by Developers for Products distributed via the Market must be processed by the Market’s Payment Processor."
One could argue that "fees received by Developers for Products distributed via the Market" only applies to apps sold through the market. If you then used your app to allow the user to buy stuff from your website, those fees would not be for "products distributed via the Market", they would be for "products distributed via your website" and would not be subject to being processed by the Payment Processor.
