This is true, I should have been more clear. There is a difference between being allowed to upload it, and being physically able to do it. I would argue that the Android Market is policed: I have heard of a fair number of occasions, both on and off the mailing lists, where people have had their apps pulled due to violating the TOS (usually without a proper explanation from Google). However, as TreKing points out, it is not foolproof so you might get away with it for a while.
