The following lines from the charter show whose interpretation of it is questionable. Hint: it isn't Rich's:
Allowed discussion topics Most of our groups are for technical discussions of Android or users helping each other. Generally we don't put hard restrictions on the topics discussed in the group: as long as the topic is relevant to Android in some way, it's welcome on our groups. We welcome announcements and discussion of products, libraries, publications, and other interesting Android-related news, but please do not cross-post. Post only to the most relevant group for your message. We even welcome (polite!) discussion of articles and ideas critical of Android--after all, we can't improve if we don't listen. Rich, I am sure, really believes his "Union of Android Developers" is trying to help all us developers. Of course, there is room for dispute on this, as M. Murphy has made clear. But users helping each other is what this group is for, even if the help turns out to be, ah, misguided;) Rich's topic most certainly is relevant to Android, therefore according to the charter which YOU cited, it is "welcome on our groups". Only by ignoring this whole passage and equivocating can you justify classifying his post as "unsolicited email of a commercial nature". Stop trying to prove the truth of "we can't improve if we don't listen". For your post really does read like nothing more than a contrived excuse not to listen to his very valid criticisms of the Market. Then again, I suppose there is likely a group more relevant, though Rich can certainly claim this group is relevant since the Market affects all developers.
