Haven't seen that app, but.....
It probably does it the same way that Market is able to install
applications chosen via the web site, without requiring the user to
confirm permissions on the device.
Officially, this is not possible either.

I absolutely wouldn't assume that. As long as the API had existed on
all the supported platforms, they are maybe using it.
