Um, well... If nothing else, there have been a variety of devices that have allowed apps to take screenshots, due to security flaws. I haven't been trying to chase down those flaws, but there are more than enough well-rated apps on the Market offering root-less screenshots that one presumes that they work, for those flawed devices. If an app can take a screenshot, it can read the contents of the recent tasks list when it is on the screen. Admittedly, it'd be easier for them to just take screenshots of the actual app, and there's a question of whether they can determine when the recent tasks list is being displayed.
